UK Immigration Update – Changes to your company ‘size’

Today the Home Office have introduced a new requirement for Tier 2 sponsors, as part of their ongoing compliance duties, to notify the Home Office where the business changes in size during the lifetime of its licence. ‘Size’ is determined by statute under the Companies Act 2016 sections 381-384. All Tier 2 sponsors must now be proactive in ensuring that any changes to its size, whether from small to medium/large or vice versa, are reported to the Home Office within 10 working days of the change taking effect in order to remain compliant with its Tier 2 sponsor duties.

The size of a business determines the applicable licence fees charged by the Home Office, as well as the amount of Immigration Skills Charge it must pay towards sponsoring non-EEA nationals under the Tier 2 regime. Futhermore, if a Tier 2 Sponsor wishes to assing a CoS to a family member of anyone within the organisation, they must disclose this to the Home Office.
